By accessing kimland.name.ng and all sub-brands: CREATIVE, CREATIVE3D, CREATIVE2D, CREATIVE DESIGN, FALCON DESIGN, EGGCELLENT DESIGN, UPSTUDIO, ALPACA, CODED, ORGANIC FLOW, MINDSHOT, LIGHTWORK, DIY, ENLIGHTENER, you agree to be bound by these Terms.
1.2 Eligibility
You must be 18+ to purchase. Users under 18 must have parental consent. By using our site you represent you have legal capacity.
1.3 Account & Purchases
1. All products are digital and delivered via download link.
2. You are responsible for keeping your order information secure.
3. Prices are in USD/NGN and subject to change without notice.
4. KIMLAND reserves the right to refuse service to anyone.
1.4 Prohibited Conduct
You agree NOT to:

Designs are concepts and CAD files only. Client is responsible for safety testing, certification, and compliance before manufacturing or construction. EGGCELLENT architectural files must be stamped by a licensed professional.
3.4 Business Advice - ENLIGHTENER
Business coaching, books, and articles are educational only. Not financial, legal, or professional advice. Results not guaranteed.
3.5 AI Content - MINDSHOT
AI outputs may contain inaccuracies. You are responsible for review before commercial use.
3.6 Limitation of Liability
KIMLAND is not liable for any indirect, incidental, or consequential damages arising from use of our products or website. Max liability = amount you paid for the product.

5.3 Copyright Infringement

We respond within 72 hours and comply with DMCA.
4. LICENSING AGREEMENT
When you purchase from KIMLAND, you receive a Non-Exclusive, Commercial License.
6.1 You CAN:
1. Use products in commercial projects: games, apps, websites, videos, physical products
2. Modify files for your own projects
3. Use in client work with unlimited seats
6.2 You CANNOT:
1. Resell or redistribute the original files
2. Share download links
3. Claim authorship of the raw assets
4. Use in AI training datasets without written permission
6.3 Extended License
For white-label, redistribution, or resale rights, contact contact@kimland.name.ng
License is granted upon successful payment and continues indefinitely.
7. PAYMENTS, REFUNDS & CANCELLATIONS
7.1 Payments
Payments processed by third-party gateways. We do not store card data. All prices exclude taxes/VAT.
7.2 Digital Product Policy
Due to the nature of digital goods, all sales are final.
7.3 Refund Eligibility
Refunds only if:
1. File is corrupted and cannot be fixed within 7 days
2. Product is materially different from description
Requests must be made within 7 days of purchase with order number.
7.4 Custom Work & Services
For FALCON, ALPACA, CODED, ENLIGHTENER custom contracts: A minimum 50% deposit or more may be required. Final payment before delivery. Cancellation terms defined in individual contract.
8. GOVERNING LAW & DISPUTES
8.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
8.2 Dispute Resolution
Any dispute will first be attempted to be resolved by good-faith negotiation. If unresolved, disputes will be settled in courts of Edo State, Nigeria.
8.3 Changes to Terms
We may update these Terms. "Last Updated" date will change. Continued use = acceptance.
