1. AGREEMENT TO TERMS
Welcome to KIMLAND LIMITED. These Terms of Service ("Terms") govern your access to and use of our website hosted on Google Sites and Google Blogger, and all products, digital assets, and services offered by our 14 brands including CREATIVE, CREATIVE3D, CREATIVE2D, CREATIVE DESIGN, FALCON DESIGN, EGGCELLENT DESIGN, UPSTUDIO, ALPACA, CODED, ORGANIC FLOW, MINDSHOT, LIGHTWORK, DIY, and ENLIGHTENER.
By accessing or using our website, you agree to be bound by these Terms. If you do not agree, do not use our website.
2. ABOUT KIMLAND LIMITED
KIMLAND LIMITED is a digital marketing and product design company. We create, productize, and license digital and physical products online. All sales and licensing are conducted digitally.
3. INTELLECTUAL PROPERTY
All content on this website including text, graphics, logos, 2D art, 3D models, code, music, photos, AI content, and software is the property of KIMLAND LIMITED and protected by copyright and trademark laws.
License to Use Our Products:
When you purchase or license products from CREATIVE, CREATIVE3D, CREATIVE2D, CREATIVE DESIGN, FALCON DESIGN, EGGCELLENT DESIGN, UPSTUDIO, ALPACA, CODED, ORGANIC FLOW, MINDSHOT, LIGHTWORK, DIY, and ENLIGHTENER, you receive a non-exclusive, non-transferable license to use the product according to the license type sold.
You may NOT resell, redistribute, or claim ownership of our assets unless you purchased an extended/commercial license.
All brand names listed in Section 14 are trademarks of KIMLAND LIMITED.
4. USER ACCOUNTS & CONDUCT
If you contact us or purchase from us, you agree to:
1. Provide accurate information
2. Not use our website for unlawful purposes
3. Not attempt to hack, disrupt, or reverse-engineer any CODED software or website
4. Not upload viruses, spam, or harmful content
We reserve the right to terminate access for violations.

DIY - Research, New Science Methodologies, Product Concepts
ENLIGHTENER - Business Coaching, Strategy, Books, Articles
All products are delivered digitally unless otherwise stated. Descriptions are as accurate as possible but we do not guarantee error-free content.
6. PAYMENTS, REFUNDS & LICENSING
1. Payments: Processed by third-party payment processors. We do not store your card details.
2. Digital Products: Due to the nature of digital goods, all sales of assets, code, music, and AI content are final. No refunds unless the product is defective or not as described.
3. Services: For ENLIGHTENER coaching, ALPACA engineering, and FALCON DESIGN and EGGCELLENT DESIGN services, refunds depend on work completed. See individual contract.
4. Licenses: You may not share login credentials or license keys. 1 license = 1 user/company unless stated.
7. THIRD-PARTY SERVICES & GOOGLE
Our website uses:
1. Google Sites & Blogger: Hosted by Google. Subject to https://policies.google.com/terms
2. Google AdSense: We display ads. By using our site you agree to Google’s ad policies. We are not responsible for ads shown.
3. Google Analytics: Used to track site usage anonymously.
We are not liable for outages or issues caused by Google.
8. DISCLAIMERS
KIMLAND provides all products and services "AS IS" and "AS AVAILABLE" without warranties of any kind.
We do not guarantee that:
1. Our website will be error-free or uninterrupted
2. Products from DIY research or ALPACA engineering will work for your specific manufacturing process without testing
3. Business advice from ENLIGHTENER will result in specific financial outcomes
You use our products and advice at your own risk.
9. LIMITATION OF LIABILITY
To the maximum extent allowed by law, KIMLAND LIMITED shall not be liable for any indirect, incidental, special, or consequential damages arising from use of our website or products.
Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
10. USER-GENERATED CONTENT
If you submit ideas, feedback, or content to us, you grant KIMLAND a worldwide, royalty-free license to use, modify, and commercialize it. Do not submit confidential information.
11. TERMINATION
We may suspend or terminate your access to our website and services at our sole discretion, without notice, for conduct we believe violates these Terms or is harmful to other users.
12. GOVERNING LAW
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in courts located in Ebonyi State, Nigeria.
13. CHANGES TO TERMS
We may update these Terms at any time. "Last Updated" date will change. Continued use after changes means you accept the new Terms.
